OSHA ETS Medical Removal Protection Benefits & Healthcare Employer Considerations for Vaccine Mandating

Overview:
The Occupational Safety and Health Administration (OSHA) published their COVID-19 Healthcare Emergency Temporary Standard (ETS) to the Federal Register on June 21, 2021, which affects providers of health care and health care support services. The Medical Removal Protection Benefit provision of the ETS establishes circumstances when employers are required to pay employees for lost time due to COVID-19 related reasons. Employers have questions about how this provision is to be put into practice while still being compliant with OSHA directive.
In addition to the Medical Removal Protection Benefits of the ETS, a hot-button item providers are being faced with is the decision to mandate COVID-19 vaccinations as a condition of employment in their organizations. There are considerations employers need to be aware of if they decide to mandate the vaccination or to keep vaccination voluntary.
